PRIVACY AND COOKIE USE POLICY

The Privacy and Cookie Use Policy of HYPPET (“Policy”) has been created to demonstrate HYPPET’s commitment (referred to here as “HYPPET,” “we,” or “our”) to the security and privacy of the information collected from our users, who are the holders of their personal data (“Holder,” “User” – NGO or Individual, or simply “you”). This Policy clarifies the general conditions for collecting, using, storing, and other forms of processing and protecting personal data in our application – App, in compliance with the current Brazilian legislation on privacy and personal data protection, including, but not limited to, Law No. 12.965, of April 23, 2014, and Decree No. 8.771, of May 11, 2016 (“Civil Rights Framework for the Internet”) and Law No. 13.709, of August 14, 2018 (“General Data Protection Law” or “LGPD”). For the purposes of this Policy, HYPPET is qualified as the Controller, as it stores your personal information, and is responsible for the decisions regarding the processing of your personal data that are collected by it. To maintain direct contact with you, HYPPET has appointed a Data Protection Officer to manage a communication channel. This Privacy and Cookie Use Policy is an integral part of the Terms and Conditions of Use of HYPPET. Acceptance of the premises set forth in this policy is an indispensable requirement for the use of the products and services provided by HYPPET. We recommend that you read it carefully.

         1.SCOPE

This Policy applies to all users of our app, with personal data collected whenever you:

Register and log in to our app;

Register a pet for donation;

Search for a pet to adopt through “I want to adopt”;

Contribute with donations;

Send us an email;

Contact us via our social media networks (Facebook, Instagram).

      2.INFORMATION WE COLLECT

Important: You are not obligated to provide your information; however, access to certain functionalities will not be permitted without providing certain requested information. To access the HYPPET app and use our services, you must register and log in, providing some mandatory information; otherwise, you won’t have full access to our services (e.g., to interact with pet guardians for adoption or to register an animal for donation). Within the limits allowed by applicable legislation, HYPPET may process the following personal data provided by you (NGO or Individual):

Registration contact information: i) for NGO: Profile photo/image, Name, Location, Instagram Profile, Phone/WhatsApp number; ii) for Individual: Profile photo/image, Full Name, Date of Birth, Location and Address, Gender, whether you’re an animal protector, additional information (not mandatory, such as: if you have children at home, if you live in a house or apartment, size of the residence, if you have other pets, occupation, number of residents in the house), Instagram Profile, Phone/WhatsApp number, and Email.

User content: A free text box where you can tell us your story when contacting us in the “tell us a bit about you” field, which we request not to contain any personal data.

Social media: It’s important to note that if you, the User, wish to interact with HYPPET via our social networks (Facebook, Instagram), you must log into your account, and only if you interact with us (e.g., sending a message) will we have access to your username and possibly to the public posts you use.

Photos and videos: If you wish to share photos and/or videos with your pets or tell us a story or experience, with your authorization, HYPPET may disclose such information on the website or social networks.

Cookies and similar technologies: In accordance with our Cookie Policy stated here.

Note that the personal data listed above will be collected by HYPPET and later processed only as necessary to achieve the purposes outlined here. We do not intentionally collect, store, or otherwise process excessive or unnecessary personal data for the provision of our services and the use of our app.

 

  1. LEGAL BASIS FOR PERSONAL DATA PROCESSING

The legal basis for processing personal data stored and processed by HYPPET, as listed in Section 2, is determined through an analysis of the specific context in which they are collected. HYPPET’s data processing generally occurs:

With your consent;

To comply with legal or regulatory obligations;

For the regular exercise of rights in legal proceedings;

To fulfill obligations from our services;

When data processing aligns with HYPPET’s legitimate interests, always considering your interests related to data protection and fundamental freedoms and rights. There may also be a need to process your data to protect your interests or those of third parties.

  1. PURPOSE OF DATA COLLECTION

The sole and exclusive purpose of collecting information is to maintain and improve the services provided to offer you a better experience. As necessary, the collected information will be used for the following purposes:

To allow you to access and use the HYPPET app;

To enable you to adopt or register a pet for adoption;

To allow you to access and, if desired, interact with us on our social media pages;

To enable you to receive our informational content via email;

To send you marketing messages, market research, opinions on our services, or from our partners;

To improve our app;

To personalize and customize your experience in our app;

To develop new products and services;

To provide information to governmental authorities when requested through subpoenas, court orders, or other legal processes to establish or exercise our legal rights, protect our property, defend against legal claims, or as required by law;

To investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical and technological safety of any person, partner companies, HYPPET, or as legally required, within the limits permitted by applicable law;

To enable you to receive gifts, invitations, newsletters, promotions, and other relationship initiatives from our partners when adopting a pet.

 

  1. SHARING OF PERSONAL DATA

When necessary to achieve the purposes described in Section 4, HYPPET may share your personal data with third parties listed below to correctly provide the offered services, ensure the security of your personal data storage, and enhance your experience with HYPPET. Sharing will always comply with our business limits and purposes, the personal data processing goals, and applicable law. Thus, your data may be shared with:

Third-party software platforms and tools for managing HYPPET’s service provision;

IT and information security service providers;

Marketing and advertising companies;

Fiscal authorities and government, police, public, and judicial bodies for responding to complaints, investigations, legal actions, and processes, and to comply with legal, regulatory, and fiscal obligations;

Partner entities to enable you to receive gifts, invitations, newsletters, promotions, and other relationship initiatives when adopting a pet.

  1. RIGHTS OF PERSONAL DATA HOLDERS

Within the limits of applicable law, you, as the personal data holder, can contact us to exercise your rights, including:

Confirmation of personal data processing;

Access to your data;

Correction of incomplete, inaccurate, or outdated data;

Anonymization, blocking, or deletion of unnecessary, excessive data or data processed in non-compliance with the law;

Data portability to another service or product provider, respecting trade and industrial secrets;

Deletion of your personal data, except under legally provided circumstances, for exercising rights related to HYPPET, or for compliance with legal requirements;

Information about public and private entities with whom HYPPET shared your data;

Information about the consequences of not providing consent;

Revocation of your consent, under certain conditions;

Opposition to data processing in specific cases where consent is not required, provided there’s a legal basis.

Requests can be made free of charge through our support channel suporte@hyppet.com. We will review and respond to your request promptly, within legally provided deadlines. If immediate compliance with your request is not possible, we will explain the factual and legal reasons for the delay. HYPPET is not responsible for the accuracy, truthfulness, completeness, or update of the data provided by the Holder, nor for misuse of information or fraud resulting from the violation of personal passwords. It is your sole responsibility to provide correct, true, authentic, complete, and updated information.

  1. HOW WE STORE AND PROCESS PERSONAL DATA

HYPPET keeps collected personal data in a controlled and secure environment to serve specific purposes, as outlined in Section 4. Personal data is confidential, with strict access control through authentication mechanisms. HYPPET implements security measures, both technical and administrative, to protect all stored data. Data collected via our app is stored, processed, and protected using best practices in hosting, processing, backup, and encryption, based on their criticality. Nevertheless, users should be aware that no internet security system is immune to unwanted invasions, and HYPPET’s commitment is to adopt recommended protection measures as per current technical standards.

 

  1. INTERNATIONAL TRANSFER OF PERSONAL DATA

HYPPET may transfer some personal data to service providers and partners abroad, including cloud services. When transferring personal data outside Brazil, HYPPET will take appropriate measures to ensure adequate protection of your personal data in compliance with applicable data protection laws, including executing appropriate data transfer contracts with third parties, as necessary.

 

  1. DATA RETENTION PERIOD

We store and maintain your information: (i) as required by law; (ii) until the personal data processing purpose is met; (iii) as necessary to preserve HYPPET’s legitimate interests; (iv) to protect HYPPET’s regular rights in legal, administrative, or arbitration processes; (v) as needed to comply with legal or regulatory obligations. Data processing will end when its purpose is achieved, the data holder requests its termination and deletion, or by legal mandate. Unnecessary data may be routinely deleted, and upon the end of processing, data will be securely stored and isolated until deletion is possible. Users can directly use the “delete user” function in the HYPPET app.

 

  1. POLICY TERM AND CHANGES

HYPPET reserves the right to unilaterally terminate, suspend, or interrupt the app, in whole or in part, at any time without prior notice, and will inform where the contained information will be available, which you have the right to access under current legislation. This Privacy Policy may be updated or changed at any time, with changes prominently announced in our app.

 

  1. COMMUNICATION POLICY

HYPPET aims to avoid sending unsolicited emails, limiting communications to topics of relevance or specific interest to you. You can opt out of receiving HYPPET information by using the unsubscribe link in emails or messages received, or by deselecting the email and promotional message authorization option in your registration page. HYPPET will never request your password or financial data via email or phone. For any suspicions, contact support via suporte@hyppet.com.

 

  1. LINKS TO OTHER SITES

Our app may contain links to other sites, intended to provide additional benefits to our users. However, HYPPET does not endorse or take responsibility for the content, products, services, practices, or privacy policies of these sites. We recommend careful review of third-party site documents, as HYPPET is not liable for any losses or damages from using these external resources.

 

  1. USE OF COOKIES.

A cookie is nothing more than a small text file that contains a unique identification tag, placed on your computer or mobile device. In this file, various pieces of information can be stored, from the pages you have visited to the data you have voluntarily provided to the website.

When you use the HYPPET App, personal information, such as your name, email, and personal interests, are stored in a cookie and sent to your internet browser or mobile device by our server, which then keeps them for later use.

Most internet browsers and mobile devices accept cookies. However, users can set their browsers and devices to refuse certain types of cookies or specific cookies. Moreover, users can delete cookies at any time.

The cookie is individually assigned to each computer/mobile device and can only be read by the server that sent it. Therefore, it is incapable of being used to infect computers/mobile devices with malicious codes of any kind, such as viruses, trojans, and others.

HYPPET uses cookies to facilitate use and better adapt its app to the interests and needs of its Users, as well as to assist and improve its structures and contents. Cookies can also be used to speed up your future activities and experiences on our services.

Cookies can be divided according to the information they store and their purpose, namely:

Necessary or Essential Cookies: These are essential for the HYPPET app to load correctly and allow you to navigate properly, as well as make use of all the available functionalities, such as the type of user you are (NGO or individual/protector, donor, or adopter). Without the essential cookies, our app does not operate correctly, hindering navigation.

Performance Cookies: Help to understand how visitors or users interact with HYPPET, providing information about the areas visited, the time spent on the site, and any problems encountered, such as error messages.

Functional Cookies: Allow the app to remember your choices, to provide a personalized experience, such as remembering the pets you liked, your username, etc.

Marketing Cookies: Are used to deliver more relevant content and of the interest of the Users. They can be used to present advertising with more targeting or limit the number of times it is shown on the HYPPET pages. They also allow the measurement of the effectiveness of an advertising campaign launched.

On your mobile device, you can change the permissions for accessing your location and other personal information through the device’s settings.
